3. Wellbeing platform – Non-medical

Best Zen Buddy is a marketing management and publishing platform. The content and tools provided are for informational purposes only and do not constitute medical advice. They do not replace a consultation with a healthcare professional.

5. Reporting, moderation, and removal

Any user may report content or behavior they believe to be unlawful, misleading, or contrary to these Terms of Use. Best Zen Buddy may, at its discretion, take moderation actions (content removal, account suspension, or account deletion).

8. Subscriptions, Payment and Cancellation

Access to the Best Zen Buddy platform requires a paid subscription, preceded by a free trial period.

Free trial period

Each new user benefits from a free trial period of fourteen (14) days, providing full access to all platform features. No payment method is required during this period. At the end of the trial period, the user must subscribe to a plan to continue using the service.

Monthly subscription

The monthly subscription is billed each month on the anniversary date of the subscription. If a monthly subscription is cancelled during a billing period, access to the service remains active until the end of the current paid month. No prorated refund is issued for the current month.

Annual subscription

The annual subscription is billed as a single payment for a period of twelve (12) months. It includes a 10% discount compared to the monthly rate, granted in exchange for the commitment to the full twelve-month period.

Cancellation of an annual subscription

If an annual subscription is cancelled before its term, the following conditions apply:

• Access to the service remains active until the end of the current month.
• The remaining months (from the month following the cancellation) are refunded.
• The 10% discount granted for the annual commitment is revoked: the refund is recalculated based on the standard monthly rate. Specifically, the amount for the months already used is recalculated at the full monthly rate, and the refund equals the difference between the annual amount paid and the total of months consumed at the monthly rate.

Calculation example

A user subscribes to an annual plan at €108 (i.e., 12 months × €10 × 0.9 after the 10% discount). They cancel after 5 months of use. Recalculation: 5 months × €10 (standard monthly rate) = €50. Refund: €108 − €50 = €58.

Refund process

Refunds are processed via the original payment method used at the time of subscription, within a maximum of fourteen (14) business days following the cancellation request. Transaction fees incurred by Best Zen Buddy at the time of the original payment are non-refundable and will be deducted from the refunded amount.

11. International Users (Outside EU/EEA)

The Best Zen Buddy platform is published and hosted in France, within the European Union (Amen.fr, Paris). It is primarily intended for users located in the European Union and the European Economic Area.

Access from abroad

Access to the platform from countries outside the EU/EEA is permitted but is at the user's sole initiative and responsibility. Users are required to verify that their use of the platform complies with applicable laws and regulations in their country of residence.

Service provided "as is"

For users located outside the EU/EEA, the platform is provided "as is," without warranty of compliance with the legal, regulatory, or technical requirements specific to their jurisdiction.

Export controls and sanctions

The user represents and warrants that they are not located in a country subject to embargo or international sanctions (including those of the European Union, United Nations, or the United States) and are not listed on any restricted persons or entities lists. Use of the platform in violation of these provisions is strictly prohibited.

Data protection

Personal data is hosted and processed within the European Union in accordance with the GDPR (General Data Protection Regulation – EU 2016/679). Users located outside the EU/EEA may have different data protection rights depending on their jurisdiction.

Applicable language

In the event of any discrepancy between the French and English versions of these Terms of Use, the French version shall prevail.

12. Users Located in the United States

The following provisions apply specifically to users accessing the platform from the United States of America:

No targeting of the U.S. market

The Best Zen Buddy platform is not intended for or directed at the U.S. market. Access from the United States is permitted but is at the user's sole initiative, and the user acknowledges using a service designed for and governed by French and European law.

Governing law and jurisdiction

These Terms of Use are exclusively governed by French law, excluding any conflict of law rules. In the event of a dispute, the courts of Avignon (France) shall have sole jurisdiction, which the user expressly accepts.

Waiver of punitive damages

To the maximum extent permitted by applicable law, the user expressly waives any right to seek punitive, exemplary, or multiple damages (including treble damages) against Best Zen Buddy.

Class action waiver

The user agrees that any claim or dispute against Best Zen Buddy shall be brought on an individual basis only, and waives any right to participate in a class action, collective action, or representative proceeding. If this waiver is found unenforceable by a court of competent jurisdiction, it shall be deemed severable and shall not affect the validity of the remaining provisions.

Liability cap

Best Zen Buddy's total liability to U.S. users is limited to the greater of (a) the fees actually paid by the user during the preceding twelve (12) months, or (b) one hundred euros (€100).

Disclaimer

Best Zen Buddy does not represent or warrant that the platform complies with U.S. federal or state laws, including but not limited to consumer protection regulations, HIPAA, or any other industry-specific legislation. The platform does not provide medical, healthcare, or regulated advisory services.

14. Right of Withdrawal (EU/EEA Consumers)

In accordance with Directive 2011/83/EU on consumer rights, users who qualify as consumers within the European Union or the European Economic Area have the right to withdraw from their subscription within fourteen (14) days of purchase, without giving any reason.

To exercise this right, the user must notify Best Zen Buddy of their decision via the contact form available on the platform before the expiry of the withdrawal period.

Exception – Digital services

By subscribing and using the platform's digital services before the expiry of the withdrawal period, the user expressly acknowledges and agrees that the performance of the service begins immediately. The user thereby waives their right of withdrawal once the service has been fully performed.

If the withdrawal is exercised before the service is fully performed, the user will be charged a proportional amount corresponding to the services provided up to the date of withdrawal notification.

Refund

Any applicable refund will be processed within fourteen (14) days of receipt of the withdrawal request, using the same payment method used for the original transaction.

17. Account Suspension and Termination by Best Zen Buddy

Best Zen Buddy reserves the right to suspend or permanently terminate a user's account, without prior notice and without compensation, in the following cases:

• Violation of these Terms of Use or any applicable law or regulation
• Publication of violent, hateful, discriminatory, defamatory, or illegal content
• Publication of content that is dangerous, misleading, or poses a risk to the health or safety of others
• Impersonation of a professional (e.g., claiming qualifications, certifications, or titles that the user does not hold)
• Failure to comply with the professional, ethical, or regulatory obligations applicable to the user's declared activity
• Fraudulent use of the platform, including but not limited to creating fake accounts, manipulating engagement metrics, or abusing AI-generated content features
• Harassment, bullying, or abusive behavior toward other users, clients, or Best Zen Buddy staff
• Use of the platform for purposes unrelated to wellness, wellbeing, or professional marketing (e.g., political propaganda, adult content, pyramid schemes)
• Repeated or serious breaches that undermine the integrity, security, or reputation of the platform

In the event of account termination, the user will be notified by email at the address associated with their account. Termination does not entitle the user to any refund, except where required by applicable law.

Best Zen Buddy may, at its sole discretion, issue a warning before suspending or terminating an account, but is under no obligation to do so.
